Demand Notice Information and FAQ's
Demand Notices are mailed as required by Indiana statute (I.C. 6-1.1-23-1) which states in part:
"...each county treasurer shall serve a written demand upon each taxpayer who is delinquent in the payment of personal property taxes."
For any taxpayer with an unpaid Demand Notice after 30 days a judgment will be entered against the taxpayer in Marion County circuit Court (I.C. 6-1.1-23-9); at which time the account begins to accrue interest of 8% per annum. The taxpayer will be notified of the judgment via letter and judgment document.
Any delinquent personal property tax accounts which remain unpaid approximately 2 weeks after the judgment notice is mailed will be turned over to a collection agency for collection (I.C. 6-1.1-23-1.5). Per Indiana statute (I.C. 6-1.1-23-7) the collection fee, legal costs, etc. are additional costs to the delinquent taxpayer.
Frequently Asked Questions:
Why am I getting this Demand Notice? This is a bill for unpaid personal, business personal, or mobile home taxes that were due last year. All or a portion of those taxes remain unpaid. Sometimes the spring installment is paid; but the fall installment is not paid. Another common reason is that the fall payment was mailed after the due date but the 10% penalty was not included.
What is this bill for? Your township assessor has entered what is being assessed in the "Property Description" field in the upper right area of the Demand Notice. If this information is not sufficient you must contact your township assessor for additional information on what was assessed.
I no longer own this property, do I still owe this tax? If you owned, or had possession of, the property on the assessment date of March 1, 2005 (January 15, 2006 for mobile homes) the tax is due for the full year.
Can personal property be sold for taxes? Yes, Indiana Statute (I.C. 6-1.1-23-1) reads in part:
"sufficient personal property of the taxpayer shall be sold to satisfy the total amount due plus additional collection expenses..."
I paid this last year! - In some cases the taxpayer pays the spring installment but not the fall installment; or there is no information on the check indicating where the payment should be posted. If you believe you paid the full tax amount please send or fax your proof-of-payment (paid receipt or front and back of cancelled check); we will research your payment and respond promptly to your inquiry.
