The Marion County Public Defender Agency provides parents with attorneys when the State of Indiana (through the Department of Child Services) files a petition accusing them of either abuse or neglect of their children. These attorneys defend the parents against the State's accusations. If the Court decides the children need services anyway, these attorneys continue to represent their clients in order to reunify the family. These are civil proceedings which implicate the parents' rights to parent their own children. If the State files criminal charges, those cases will be heard in one of the Criminal courts. Often the two cases proceed at the same time in the two different court systems.
The Agency attorneys are divided into four teams. Each case will have a lead attorney assigned whom has primary responsibility for the case. The other members of their team will assist lead counsel and may cover in court for the lead attorney at any given hearing.
