Approvals (Regional Center, Etc.)

Board of Zoning Appeals Approval Petition An approval petition would be required to modify conditions, commitments and site plans, as well as the appeal of administrative decisions related to an Improvement Location Permit or other administrative decisions related to the Marion County Zoning Ordinances. Filing In order for a petition to be heard by a division of the BZA, it must be filed, with consent of the property owner(s), at least 35 days before a scheduled hearing. Each petition, timely filed and complete, is docketed for hearing; however, no more than 10 new cases will be docketed for a hearing. All other timely filed petitions will be docketed for the next available hearing. Generally, in order to file a complete application, the following would be required: - A completed application form
- Consent of the property owner
- A legal description
- A zoning base map, copies of which are available in Suite 1821 of the City-County Building (317-327-5155) for a fee of $1.00 per map (Please shade, crosshatch, or circle property being considered)
- Three copies of the site plan (and other plans, as needed)
- Findings of fact
- The applicable filing fee (nonrefundable)
Metropolitan Development Commission/Hearing Examiner Approval Petition An approval petition would be required to modify conditions, commitments, site plans and planned unit developments as well as the appeal of administrative decisions related to cluster plan and regional center review. Filing In order for a petition to be heard by the MDC or Hearing Examiner, it must be filed, with consent of the property owner(s), at least 35 days before a scheduled hearing. Each petition, timely filed and complete, is docketed for hearing. Generally, in order to file a complete application, the following would be required: - A completed application form
- Consent of the property owner
- A legal description
- A zoning base map, copies of which are available in Suite 1821 of the City-County Building (317-327-5155) for a fee of $1.00 per map (Please shade, crosshatch, or circle property being considered)
- Rezoning ordinance
- Commitment forms, and
- The applicable nonrefundable filing fee (The requirements for other petitions will vary, see the appropriate petition checklist)
REGIONAL CENTER / NORTH MERIDIAN STREET CORRIDOR The Regional Center Zoning Ordinance is a secondary overlay zoning ordinance that provides for additional review of development within the boundaries of the Regional Center and the North Meridian Street Corridor. The Regional Center Zoning Ordinance covers territory generally bounded by I-70 on the east and south, I-65 on the north, and Miley Avenue on the west. The North Meridian Street Corridor extends north of I-65 to 30th Street, within an area generally a half-block east of Pennsylvania Street and a half-block west of Illinois Street. This Ordinance was developed to implement recommendations of the Regional Center Plan and the North Meridian Street Corridor Plan. The basic requirement of this Ordinance is that all use changes and all exterior modifications to a site, building, or sign be submitted for review, by official application, to the Current Planning Section of the DMD. The Regional Center Zoning Ordinance includes specific requirements for the North Meridian Street Corridor. Certain existing uses are prohibited and must be amortized. Other specific uses are not permitted to be established, but may remain, if existing. It includes specific development standards for uses and signs, which add or supersede the requirements of the underlying zoning district and the Sign Regulations. Filing a Regional Center Approval In order for a Regional Center petition to be reviewed, it must be filed, with consent of the property owner(s). Each petition, timely filed and complete, is assigned to a planner. Generally, a Regional Center petition is processed within two weeks of filing. Generally, in order to file a complete application, the following would be required: - A completed, typewritten application, signed by the owner of the subject property or an authorized agent, and notarized
- A consent form, if applicable
- A legal description
- A zoning base map, copies of which are available in Suite 1821 of the City-County Building (317-327-5155) for a fee of $1.00 per map (Please shade, crosshatch, or circle property being considered)
- A site plan (3 copies)
- Color elevation plans (3 copies), including materials (and other plans, as needed)
- A completed checklist
- A non-refundable filing fee, with checks made payable to the City Controllerq A completed checklist, and

Appeals A petitioner or remonstrator (anyone opposing a decision) has the right to appeal a decision to the Metropolitan Development Commission, within 10 calendar days of the decision. Special Districts Approval Petition An approval petition is required for significant construction or remodelling in the Hospital Districts, University Quarter Districts, and Park Districts. These approval petitions are heard by Metropolitan Development Commission/Hearing Examiner. Generally, in order to file a complete application, the following would be required: - A completed application form

- A legal description
