Frequently Asked Questions for Tort Claims
- When will I get my money?
If your claim is properly filed, the Office of Corporation Counsel will investigate it and will notify you in writing within 90 days of receipt if your claim has been approved.
- Why do they investigate?
Each Tort Claim is investigated to make a detailed inquiry or examination to determine if the City of Indianapolis was negligent.
- Why does it take so long? I need my money now!
Under Indiana Law (I.C. 34-13-3-11) the City of Indianapolis - Marion County has ninety (90) days to respond before further legal action may be filed.
- Does the City pay for fresh tar on my vehicle?
Our office will complete its investigation of your claim in which you allege that your vehicle was damaged when it came in contact with tar used by the City of Indianapolis to repair a City maintained road.
- How will I get my answer?
We will notify you in writing within 90 days of receipt if your claim is approved. A claim is denied if not approved within 90 days.
- Does the City pay for damage to cars from potholes?
Each Tort Claim will be investigated and analyzed and a determination will be made with respect to each claim. If you see a pothole, please call 327-4MAC (4622).
- Does the City pay for damage from painted lines?
Our investigation includes contacting the Department of Public Works which has charge of the maintenance of City of Indianapolis - Marion County streets and will be analyzed accordingly.
